Terms and Conditions

Effective Date: November 2024

Introduction

Welcome to Field Day Parties LLC. These Terms and Conditions govern your access to and use

of our website (www.fielddayparties.com) as well as our services, including the planning and

execution of events. By using our website or booking our services, you agree to these Terms. If

you do not agree, you must refrain from using our website or services.

Booking and Payment

All bookings are subject to availability and require a signed agreement and payment of the

required deposit to confirm the event date. A deposit of at least $100 is required at the time of

booking, and the remaining balance must be paid immediately following the end of the event.

However, if your event is larger or a school program, then Field Day Parties LLC reserves the

right to request a larger deposit. Cancellations made more than 14 days before the event will

receive a full refund minus any administrative fees. Cancellations made within 14 days of the

event are non-refundable. Refunds are issued solely in accordance with the cancellation policy.

No refunds will be provided for partial attendance or dissatisfaction with services unless

determined otherwise at the sole discretion of Field Day Parties LLC. Events may be rescheduled

at our discretion due to unforeseen circumstances, including inclement weather or safety

concerns.

Safety Requirements and Client Responsibilities

Clients are solely responsible for ensuring that the event location is safe and suitable for the

planned activities. This includes providing a flat, clear space free from hazards such as debris,

unstable surfaces, or obstructions. Clients must ensure the property is adequately insured to

cover potential damages or injuries. Field Day Parties LLC is not responsible for any injuries,

damages, or accidents caused by unsafe conditions or the failure of the client to meet these

requirements. We reserve the right to refuse to proceed with an event if the location is deemed

unsafe, and no refunds will be provided in such circumstances.

Supervision of Minors and Event Modifications

Parents, guardians, or other responsible adults designated by the client must supervise all minor

participants. Field Day Parties LLC staff will facilitate activities but are not responsible for the

direct supervision of children. If weather or other conditions pose safety risks, we reserve the

right to modify or cancel activities. In such cases, we will work with the client to make

alternative arrangements or reschedule the event.

Assumption of Risk and Release of Liability

By booking services with Field Day Parties LLC, I acknowledge and accept that participation in

activities organized by Field Day Parties involves inherent risks. These risks include, but are not

limited to, physical injuries (e.g., sprains, fractures, concussions), property damage, illness,

exposure to contagious diseases such as COVID-19, and unforeseen accidents. I understand that

these risks may arise from my own actions or negligence, the actions or negligence of other

participants, third parties, environmental factors, or conditions beyond the control of Field Day

Parties.

I further acknowledge that participation involves the risk of exposure to infectious diseases,

including but not limited to COVID-19, which may result in severe illness, permanent disability,

or death. I understand that such exposure or infection may result from the actions, omissions, or

negligence of Field Day Parties, its owners, employees, contractors, agents, volunteers, or other

participants. I voluntarily assume all risks related to exposure to infectious diseases and

understand that Field Day Parties cannot guarantee a risk-free environment.

In consideration of the services provided by Field Day Parties, I expressly agree to release,

indemnify, and hold harmless Field Day Parties, its owners, employees, contractors, agents, and

volunteers from any and all claims, damages, losses, liabilities, or expenses arising from or

related to:

• Injuries, illnesses, or accidents sustained during activities, whether caused by the

negligence of participants, third parties, or environmental factors.

• Property damage, theft, or loss occurring at the event location.

• Exposure to or infection by contagious diseases, including but not limited to COVID-19.

• Disruption, cancellation, or modification of the event due to weather, acts of God, public

health crises, or other unforeseen circumstances.

• Actions, omissions, or negligence of participants, third parties, or Field Day Parties in

connection with the event.

• Any other claims, damages, or liabilities arising out of or related to the event or services

provided by Field Day Parties.

This release of liability applies to all participants, guests, and attendees at the event. I understand

that it is my responsibility to inform all participants, including minors, of these risks and to

ensure their compliance with the instructions and safety measures provided by Field Day Parties.

Field Day Parties LLC shall not be held liable for any claims, damages, or losses exceeding the

amount paid for the services. By signing this release, I acknowledge and accept full

responsibility for my own participation and, if applicable, my child’s participation. I further

agree to indemnify and defend Field Day Parties against any claims brought by third parties

arising from or related to my or my child’s participation in the activities.

Indemnification

Clients agree to indemnify and defend Field Day Parties LLC, its owners, employees,

contractors, and agents against any claims, damages, losses, liabilities, and expenses, including

attorney fees, arising from the client’s failure to ensure the safety of the event location; the

supervision, actions, or behavior of participants or attendees, including minors; violations of

these Terms by the client or participants; and any claims brought by third parties arising from or

related to the event.

Waiver of Claims

To the fullest extent permitted by law, clients waive any and all claims against Field Day Parties LLC for injuries, damages, losses, or liabilities, including those resulting from negligence, acts of God, or other unforeseen circumstances.

Choice of Law and Dispute Resolution

These Terms and Conditions, as well as any disputes arising under or related to them, are

governed by the laws of the State of New Jersey, without regard to its conflict of law principles.

Any disputes must first be submitted to mediation, where both parties agree to make a good faith

effort to resolve the matter. If mediation does not result in a resolution, the dispute shall be

resolved through binding arbitration in accordance with the rules of the American Arbitration

Association. The arbitration will take place in Bergen County, New Jersey, and the arbitrator's

decision shall be final and binding on all parties. Each party shall bear its own legal fees and

costs unless the arbitrator determines otherwise. By agreeing to these Terms, clients expressly

waive their right to file or participate in any class action lawsuits or consolidated claims against

Field Day Parties LLC. Clients further agree to submit to the exclusive jurisdiction of the courts

in New Jersey for enforcement of arbitration awards or for any disputes not resolved through

arbitration.

Field Day Parties LLC reserves the right to update or modify these Terms at any time. Changes

will be effective immediately upon posting on our website. Continued use of our website or
